The applicant was convicted of corruption (neglect of duty) contrary to section 2(i) of the Anti Corruption Act, sentenced to five years imprisonment and he appealed. He subsequently applied for bail pending appeal.

The court considered whether or not to grant the applicant bail.

Headnote and Holding: 

The court held that the requirement to prove exceptional circumstances was not mandatory. The court was satisfied that, nonetheless, the applicant was suffering from diabetes mellitus which required special treatment that he couldn’t access from custody. The court accordingly concluded that the applicant had proved exceptional circumstances and granted him bail
