The applicant was convicted of two counts of murder and attempted murder contrary to sections 188, 189, 204(a) of the Penal Code Act, sentenced to 18years and 12 years respectively and he appealed. The court considered whether or not to grant the applicant bail. He applied for bail pending appeal.

Headnote and Holding: 

The court held that the applicant had to prove exceptional circumstances to warrant the grant of bail pending appeal. The court was not satisfied that the applicant would not receive HIV/AIDS treatment while in prison. The court accordingly concluded that the applicant had not proved exceptional circumstances for grant of bail pending appeal and declined to grant the applicant bail pending appeal.
