Namusoke Vs Uganda (CRIMINAL APPLICATION NO. 56 OF 2016) [2019] UGCA 129 (9 April 2019);

Flynote:

Search Summary:

The applicant was convicted of kidnap with intent to procure a ransom contrary to section 243(1)(c) of the Penal Code Act, sentenced to 11 years and nine months imprisonment and she appealed. She applied for bail pending appeal.

Headnote and Holding:

The court considered whether or not to grant the applicant bail. The court held that the length of the term of imprisonment against which the applicant was appealing could be one of the factors that could induce a convict to abscond. The court was satisfied that the sentence of 11 years and nine months imprisonment against which the applicant was appealing was long that it could tempt her to flee. The court accordingly declined to grant the applicant bail pending appeal.
