This was an appeal from the decision of the Court of Appeal where it confirmed the decision of the High Court. The ground of appeal was that, the learned Judges of the Court of Appeal erred in law and fact when they held that the appellant had voluntarily submitted to the jurisdiction of the United Kingdom Court.

Headnote and Holding: 

It was found that, by entering unconditional appearance, the appellant submitted to jurisdiction. It was further found that negotiations between parties to settle any liabilities outside court do not amount to submission to jurisdiction of the court. Thus judgment was by law not enforceable against the appellant.
