In this case, five revision files were addressed to the Registrar regarding the propriety of proceedings by the various Local Council III Courts as courts of first instance.

 

The appellant argued that the Local Council III courts acted without jurisdiction and that their actions needed to be checked. The court, considered issues that, whether the courts acted with jurisdiction in determining the land disputes as courts of first instance, and the effects thereof.

Headnote and Holding: 

From the evidence on record, court found that the Local Council Courts no longer had jurisdiction in land matters as courts of first instance. The court thus found all the decisions of the Local Council Courts to be null and void.

 

Thus, the court directed that a retrial of the matter shall be done in accordance with the law, if the parties wished so.
