This is an appeal against the decision of the lower court. In execution of judgment to recover the decree sum the appellant issued a cheque to for the release of a client from civil prison. The cheque was dishonoured hence the suit to recover the sum.
Headnote and Holding:
Court held that the respondent was not a holder of the cheque and could not bring an action against the appellant. Further, there was no notice of dishonour and none was pleaded and thus could not arise.
