STATUTORY INSTRUMENTS
2012 No. 3. The Condominium Property (Amendment) Regulations, 2012.
(Under section 56 of the Condominium Property Act, 2001).
In exercise of the powers conferred on the Minister by section 56 of the Condominium Property Act, 2001, these Regulations are made this 11th day of November, 2011.
- Title
These Regulations may be cited as the Condominium Property (Amendment) Regulations, 2012.
- Replacement of regulation 25 of S.I. No. 29 of 2002
The Condominium Property Regulations, 2002, in these Regulations referred to as the principal regulations are amended by substituting for regulation 25 the following—
“25. Form of notice of appointment of member of board and form of notice of person ceasing to be member of board.
- Where a person becomes a member of the board, the notice required by section 26(2) of the Act to be filed at the Land Registry in respect of the appointment shall be in Form IIA set out in the Fifth schedule.
- Where a person ceases to be a member of the board the notice required by section 26 (2) of the Act to be filed at the Land Registry in respect of ceasing to be a member of the board shall be in Form IIB set out in the Fifth Schedule.
- Amendment of regulation 26
The principal regulations are amended by substituting for regulation 26 the following—
“26. Registration, amendments and revocation of rules.
- The rules of a corporation made under section 30 shall be registered with the Registrar and upon the registration of the rules, the Registrar shall issue a duplicate of the registered rules to the corporation.
- In the case of rules made before the commencement of these Regulations, the registration shall be effected within six months after the commencement of these Regulations.
- A notice of amendment or revocation of the rules of a corporation required to be filed by section 30 of the Act in respect of the amendment or revocation shall be in Form III specified in the Fifth Schedule.
- Amendment of Fifth Schedule to principal regulations.
The Fifth Schedule to the principal regulations is amended by inserting immediately after Form II the following—
