The National Lotteries (Miscellaneous Provisions) (Amendment)

Regulations, 2012.

(Under section 8 of the National Lotteries Act, Cap 191).

In exercise of the powers conferred upon the Minister responsible for finance by section 8 of the National Lotteries Act, these Regulations are made this 2nd day of April, 2012.

  1. Title.

These Regulations may be cited as the National Lotteries (Miscellaneous Provisions) (Amendment) Regulations, 2012.

  1. Amendment of S.I 191-1.

The National Lotteries (Miscellaneous Provisions) Regulations, in these regulations referred to as the principal regulations are amended by substituting for regulation 3, the following—

“3. National Lotteries Board.

(1) There shall be a board known as the National Lotteries Board which shall consist of—

  1. one person with knowledge and experience in lotteries who shall be the chairperson of the Board;
  2. three public officers with knowledge and experience in lotteries representing—
  1. the ministry responsible for finance;
  2. the ministry responsible for justice and constitutional affairs;
  3. the ministry responsible for internal affairs;

  1. one person from the private sector, with knowledge and experience in lotteries.
  1. The members of the board shall be appointed by the

Minister.”

  1. Replacement of regulation 4 of the principal Regulations.

The principal Regulations are amended by substituting for regulation 4, the following—

“4. Duties of the board.

The duties of the board are—

  1. to administer the Lottery Fund ;
  2. to advise the Minister on the licensing of an agent to conduct the National Lottery;
  3. to monitor and supervise lotteries and agents licensed to conduct the National Lottery and ascertain that lotteries are conducted in accordance with the Act, these regulations or any licence issued by the Minister;
  4. to recommend to the Minister the establishment of a social responsibility program under the Lottery Fund;
  5. to implement the social responsibility program established by the Minister;
  6. to ascertain and report to the Minister the number of tickets issued in respect of lotteries;
  7. to advise the Minister on matters relating to lotteries;
  8. to ascertain that the interests of every participant in the National Lottery are adequately protected;
  9. to perform any other duties in respect of lotteries as may be assigned by the Minister in writing.”
  1. Insertion of new regulation 5A.

The principal Regulations are amended by inserting immediately after regulation 5, the following—

“5A. Licensing agent to conduct National Lottery.

The Minister may on the recommendation of the board license an agent to conduct the National Lottery.”
