The Local Governments (Functions of a Town Board) Instrument, 2006
(Under section 48A of the Local Governments Act, Cap. 243)
In exercise of the powers conferred on the Minister responsible for local government by section 48A of the Local Governments Act, this Instrument is made this 5th day of April, 2006.
- Title
This Instrument may be cited as the Local Governments (Functions of a Town Board) Instrument, 2006.
- Functions of a town board
The functions of a town board shall be as follows—
- to control development through enforcement of building rules,
regulations and inspections to ensure compliance with building plans;
- to serve as a focal point and co-ordinator for physical planning in the
area of authority of the town board;
- to carry out the enforcement of laws, bye-laws and ordinances to
strengthen the maintenance of order and orderly developments;
- to prepare neighbourhood structures plans for the area of authority of
the town board;
- to ensure that buildings and civil works are not located under electric
power pylons or on sewer lines and drainage channels; f) to ensure that the area of the town board is clean at all times;
- to ensure that garbage is collected and disposed of on a regular basis;
- to ensure that the residents in the area of the town board have proper
sanitation facilities and maintain acceptable levels of hygiene including environmental care and protection that promote high health standards;
- to ensure that markets are properly organised and well maintained with
basic facilities;
(j) as stipulated in Part Ill of the Second Schedule to the Local Governments Act, to prohibit, restrict, regulate or licence—
- erection of stalls on urban streets or the use of any part of the street or public places for the purpose of carrying on any trade or business;
- the depositing on any street, public place or unoccupied land of
any refuse, rubbish, derelict vehicles or any other material or thing;
- the keeping of dogs or other animals and poultry;
- together with the local government, provide for the seizure and
destruction of unclaimed, unlicensed, diseased or dangerous dogs and the seizure and disposal of stray animals and poultry;
- cinema, video halls and night clubs.
(k) to assist the lower local government in the collection of revenue in the area of authority of the town board;
(l) any other function assigned to the town board by the District Council.
