STATUTORY INSTRUMENTS. 2002 No. 64.

The Communications (Establishment and Management of the Rural Communications Development Fund) (Amendment) Instrument, 2002.

(Under sections 96(1) and 5aa of the Uganda Communications Act, 1997, Act No. 8 of 1997

In exercise of the powers conferred upon the Commission by section 96 (1) of the Uganda Communications Act, 1997, this Instrument is made this 4th day of September, 2002.

1.           Citation.

This instrument may be cited as the Communications (Establishment and Management of the Rural Communications Development Fund) (Amendment) Instrument, 2002 and shall be read as one with the Communications (Establishment and Management of the Rural Communications Development Fund) Instrument, 2002, in these Regulations referred to as the “principal Regulations”.

2.           Amendment of regulation 5.

The principal Regulations are amended by substituting for regulation 5(2) the following—

“(2) The Board shall be appointed by the Commission and shall consist of the following—

(a)                                        one Commissioner of the Uganda Communications Commission who

shall be the Chairperson of the Board;

(b)  the Executive Director of the Uganda Communications Commission;

(c)    a representative of the Ministry responsible for communications who

shall be an ex-officio member;

(d)    a nominee of the communications sector nominated for appointment

by the major licence holders;

(e)                                        a nominee of recognised consumer associations;

(f)                                        a nominee of the financial sector nominated for appointment by the

Uganda Institute of Bankers;

(g)                                           a nominee of the Uganda Institution of Professional Engineers

nominated for appointment by the Uganda Institution of

Professional Engineers”.

3.           Amendment of regulation 11.

Regulation 11(1) of the principal Regulations is amended by substituting for the word “Board” appearing at the end of the sentence the word “Commission”.

4.           Amendment of regulation 19.

Regulation 19 of the principal Regulations is amended by repealing sub­regulation (2).

5.          Amendment of regulation 2 Regulation 20 of the principal Regulations is amended by substituting for sub regulation (2) the following—

“(2) The Auditor General shall submit to Parliament annually a report of the accounts audited by him or her under regulation 19 (4) of these Regulations for the financial year immediately preceding”.
