THE ARMED FORCES (DISABILITY, DEATH PENSIONS AND GRATUITIES) (AMENDMENT) REGULATIONS, 2001.

The Armed Forces (Disability, Death Pensions and Gratuities) (Amendment) Regulations, 2001.

(Under section 2 of the Armed Forces Pensions Act, Cap 298).

In exercise of the powers conferred upon the President by section 2 of the Armed Forces Pensions Act, these Regulations are made this 1st day of February, 2001.

1.          Citation. (S.I. No. 119 of 1968.)

These Regulations may be cited as the Armed Forces (Disability and Death Pensions and Gratuities) (Amendment) Regulations, 2001 and shall be read as one with the Armed Forces (Disability and Death Pensions and Gratuities) Regulations, 1968 in these Regulations referred to as the principal Regulations.

2.           Commencement.

These regulations shall be deemed to have come into force on the 1st day of February, 1986.

3.          Amendment of principal Regulations.

Regulation 15 of the principal Regulations is amended—

(a)  by substituting for paragraph (a) of sub-regulation (1), the following—

“(a)where the deceased leaves a sole widow, a pension to her at the rate of three-quarters of the rate of pay applicable to the rank of the deceased at the date of computation of the pension and if there is more than one widow, the pension shall be divided equally between them.”

(b)    in paragraph (c) of sub-regulation (1) by substituting for “one eighth”

appearing in the fourth line the expression “one sixth”.

(c)                                    by substituting for sub-regulation (5), the following—

“(5) In addition to the pension set out in sub-regulation (1) of this regulation, a gratuity equivalent to twelve months pay at the rate of pay applicable to the rank of the deceased at the date of computation of the gratuity shall be payable; where the deceased leaves a sole widow, the gratuity shall be payable to her and if there are more than one widow, the gratuity shall be divided equally among them; if the beneficiaries are children or orphans, the gratuity shall be payable to their guardian or guardians for the equal benefit of the children or orphans.”


(d)        by substituting for sub-regulation (6), the following—

“(6) Where the deceased leaves neither a widow nor children, the Board may, at its discretion award a gratuity to any surviving parents, brothers and sisters of the deceased of an amount not exceeding twenty- four months pay at the rate of pay applicable to the rank of the deceased at the date of computation of the gratuity; such gratuity to be distributed at the discretion of the Board.”
