CHAPTER 263
THE PRESIDENTIAL EMOLUMENTS AND BENEFITS ACT.
Commencement: 1 July, 1998.
An Act to provide for the salaries, allowances and other benefits of a
President and a Vice President in accordance with articles 106 and
108 of the Constitution and for other related matters.
1. Salary, allowances and other benefits of the President.
The President shall be paid the salary and allowances and shall be afforded the other benefits specified in relation to the office of President in the First Schedule to this Act.
2. Salary, allowances and other benefits of the Vice President.
The Vice President shall be paid the salary and allowances and shall be afforded the other benefits specified in relation to that office in the Second Schedule to this Act.
3. Benefits for a President ceasing to hold office.

A President who ceases to hold office otherwise than by being removed under article 107(1)(a) or (b) of the Constitution shall be granted the benefits specified in the Third Schedule to this Act.

A President to whom subsection (1) applies shall not qualify for a grant of benefits under that subsection—

unless he or she is ordinarily resident in Uganda;
-
if he or she has engaged in and been convicted by a court of subversive activities against Uganda;
-
if he or she has personally been involved in and been convicted of embezzlement of public funds;
-
if he or she has been established by a court to have been personally involved in extrajudicial killing.
(3) In this section, “extrajudicial killing” means the killing of a
human being not in accordance with law whether or not authorised by any
organ of State.
4. Benefits of surviving spouse or spouses and dependent children of
a deceased retired President.
The benefits specified in the Fourth Schedule to this Act shall be enjoyed together by the surviving spouse or spouses, as the case may be, and dependent children of a deceased retired President for six months after the death of the retired President.
5. Disapplication of the Parliament (Remuneration of Members) Act.

With effect from the coming into force of this Act, the provisions of the Parliament (Remuneration of Members) Act shall not apply to any period in respect of which a person is paid or granted any salary, allowances or benefits under this Act.

Nothing in this section shall deprive any person of any right which has accrued to him or her under the Act referred to in subsection (1) in respect of any period before the application of this Act to that person.

Parliament may, by resolution, make such adjustments as may be necessary to accommodate any person who acts temporarily in the office of President or Vice President.
6. Amendment of Schedules.
Parliament may, by resolution, amend any of the Schedules to this Act.
7. Application of the Parliament (Remuneration of Members) Act.
For the avoidance of doubt, section 3 of the Parliament (Remuneration of Members) Act, shall continue to apply to a President or Vice President who ceased to hold that office before the commencement of the Constitution.
8. Application of sections 1, 2 and 3.
For the avoidance of doubt, sections 1, 2 and 3 of this Act, as the case may be, apply only to a President or Vice President under the 1995 Constitution.

Third Schedule.
s. 3.
Benefits for a President ceasing to hold office.
Benefits to be granted to a President who ceases to hold office otherwise than by being removed under article 107(1)(a) or (b) of the Constitution.

Allowance which is 60 percent of the salary of that President’s last salary.

Fully-furnished house provided by the State. In the case of furniture, initially the retired President shall be given twenty million shillings for the procurement of furniture. After every five years ten million shillings shall be paid to the retired President to enable him or her to replace the furniture.

Government-paid chauffeur-driven car.
-
Three hundred thousand shillings per month shall be provided to the retired President to cater for medical treatment of the retired President and his or her immediate family.

Four Government-paid security guards.

Transport for security guards.

Secretary (senior personal secretary).
-
Five hundred thousand shillings shall be provided each month to the retired President to meet expenses on utilities (electricity, telephone, water).

Two domestic staff.

Benefits to be granted to surviving spouse or spouses and dependent
children.
Benefits to be granted to surviving spouse or spouses and dependent children upon death of a retired President.

An allowance which is equivalent to half of what the retired President was earning as salary before his or her death for a period of six months.
