In this case, the plaintiff sought for court order compelling the defendant to surrender the duplicate certificate of title, so that the plaintiff be registered as executors.

 

The defendant argued that he could not in law pass on any interest to the plaintiff since they were not registered on the titles, as such the defendant could not pass an interest to the plaintiff.

 

Headnote and Holding: 

It was further found that the plaintiff was fraudulent in his dealings and this justified the conduct of the defendants.

 

The application was thereby decided in favor of the defendant with costs.
