Search Summary: 

The appellant bought the suit land from a vendor who had bought it from a third party that fraudulently obtained letters of administration in respect to the suit land. The respondent’s action challenging the appellant’s registration as the proprietor of the suit land succeeded and the appellant appealed contending inter alia that the trial judge erroneously interpreted the conflicting statutory provisions.

Headnote and Holding: 

The court held that since the R.T.A was a later and special act its provisions had to prevail over those of the S.A which was earlier and general.
