When this case was called for hearing, counsel for the respondent raised a preliminary point of law that the case was not duly registered before the honorable court as there was no evidence of payment of court fees and the Magistrate Grade 1 had proceeded and made rulings on the high court file yet those powers only lie with the Chief Magistrate.

Headnote and Holding: 

The court held that the learned Grade 1 Magistrate did not have the jurisdiction to act as he did because under order 44 rule 6, all such preliminary steps should have been handled by the district registrar or chief magistrate.
