When this appeal came up for hearing, Counsel raised a preliminary objection that he had been instructed by the owner of the suit property to appear in the proceedings and pursue his interest in relation to his property. That his client is the registered proprietor of the suit property and he is in possession and that any decision arrived at in this court is likely to affect him. In the circumstances, he applied for an adjournment so that he might be added as a party in order for court to reach a just decision.
