Search Summary: 

This was an application for orders that the Jinja District Land Board be added as a defendant in the main suit.

The main ground was that it was necessary for the board to explain to court the circumstances under which the suit land was allocated to the respondent, despite the applicant’s existed occupancy.

 

Counsel for the applicant stated that the applicant’s lease on the land was still in place until 2024, thus the allocation and the current free hold title in the respondent’s favor was fraudulent.

 

The respondent disagreed to the application stating that it was a mere waste of time.

 

Headnote and Holding: 

However, the court found that it was the board that granted the free hold title and thus it was necessary for the board to be joined as party to the suit.

 

 

The application was accordingly allowed and the applicant permitted to join the board as a third party in the suit.
