Search Summary: 

The appellant leased the suit land to the respondent who was expelled and
property vested in the custodian board. The respondent repossessed the land
granting tenancy to another person. The appellant claimed re-entry due to
non-payment of rent, vacant possession and a permanent injunction against
the respondents. The trial court entered judgment for the respondent and the
appellant’s appeal to the court of appeal was dismissed hence this appeal.

Headnote and Holding: 

The court observed that the respondent was in breach of the lease agreement
when he sub-leased the premises without the consent of the lesser, failed to
pay ground rent and the appellant’s re-entry with the above breaches the
lesser was entitled to re-entry.
The appeal was allowed and court declared the appellant as lawful owner of
the suit land.
