The respondent sued the appellant, who was granted a lease
on the suit plot by the town council, claiming compensation
for structures he developed on the suit land during the
period of his lease. The trial court entered judgment in his
favour and the appellant appealed.

Headnote and Holding: 

The court held that the old
licensee’s inters in the land ceased with the expiry of the
licence and compensation for improvements on the land
had to be agreed upon. The court was satisfied that the
responded had no contractual relationship with the

appellant and the developments had not been authorised by
the council under the lease. The court accordingly
concluded that the respondent wasn’t entitled to the sought
remedies.
