This is a second appeal from the decision of
the trial magistrate. On appeal, the appellant
dropped the rest of the grounds and pursued
one of where the judge erred in law when she
set aside the whole judgment of the magistrate
without giving remedies,

Headnote and Holding: 

The court held that as the second appellate
court, it is only required to consider matters of
law. That any transaction entered contrary to s
39(1) of the land Act is null and void and the
couching of the section is mandatory. That the
purchaser has a right to claim from any person
with whom he entered into the transaction any
money paid or any consideration given by him
in respect of the transaction.
