The ruling arose from a preliminary objection
raised by the defendant’s counsel where the
plaintiff files a suit after 20years have lapsed
after the defendant defaulted to pay the bonds
even until when they matured.

Headnote and Holding: 

The court considered whether the suit was time
barred. The court held that subject to the law of
limitation, any suit based on contract brought
after the expiration of 6 years ought not to be
entertained. Further that even though the
applying equity was of no help after 20years
when the cause of action arose. The court
being satisfied with such delay had no choice
but to struck out the plaint with costs.
