The court observed that the only issue was whether the judge had erred in
ordering prohibition against the appellant. The court observed that in judicial
review proceedings the court is not required to vindicate anyone’s rights but
to examine the circumstances under which the impugned act was done was
fair, rational and in accordance with the rules of natural justice. The court
observed that the appellant should have proceeded by filing a substantive suit
against the respondents rather than appeal.
