In this case the applicants sought court for an order of temporary injunction against the
respondents. This was to restrain the respondents with their agents from dealing in any
way with the suit land till the disposal of the determination of the main suit.

Headnote and Holding: 

Court considered whether there were conditions present in the applicants’ application
to warrant grant of a temporary injunction to them. Court held that no conditions had
been established. Court was satisfied from its findings that the applicants had failed to
prove that they had a prima facie case against the respondents in this matter. The
respondents were able to show that they had a valid certificate of title and were already
using the suit land. Therefore the balance of convenience tilted in favor of the

respondents for it would result into injustice on the part of the respondents.
Accordingly court dismissed the applicants’ application for temporary injunction.
