Injunctions and interdicts

Mbabali v Uganda Commercial Bank (CIVIL SUIT NO. 261/93) [1993] UGHC 27 (12 May 1993);

Flynote:

Search Summary:

This was an application brought seeking for an order of a temporary injunction to restrain the defendant/respondent from selling the plaintiff’s/applicant’s property.

Headnote and Holding:

The court held that one of the essential elements for grant of a temporary injunction is existence of a main suit and in the instant case, the main suit was filed without first serving on the defendant/respondent the necessary statutory notice of intention to sue which is mandatory and failure to comply with it is fatal to the proceedings.
