The suit was initiated against the defendant whom, it was alleged that, with intent to defraud, misled the officials of the first plaintiff to alter a will, thereby obtaining part of land of the second, third, fourth and fifth plaintiff which she later registered in her own names.

The plaintiffs contented that an order be made for cancellation of the defendant’s certificates of succession and of title.

 

Having not filed a written Statement of Defense, the matter proceeded ex parte in the absence of the defendant.

 

Headnote and Holding: 

The court therefore in evaluation of the evidence concluded that the defendant had acted with fraud and was not entitled to a share of the land that was clearly bequeathed to the plaintiffs.

 

Court thus ordered for the cancellation of all alterations made in contradiction of the original distribution in accordance to the will.
