Evaluation of Evidence

Abudalla Nabulere & 2 Ors Vs Uganda (CRIMINAL APPEAL NO. 9 OF 1978) [1978] UGSC 5 (5 October 1978);

Flynote:

Search Summary:

The appellants attacked the deceased in her hut and hacked her to death with pangas. They were convicted of murder and they appealed contending that they were not identified as the assailants.

Headnote and Holding:

The court considered whether the trial court erroneously relied on identification of a single witness to convict the appellants. The court held that, where the quality of identification was good, a court could safely convict on uncorroborated evidence of a single identifying witness provided that it adequately warned itself of the special need for caution.
