The appellant severely cut his father to death because he (the deceased) refused to give him land. The appellant was convicted of murder and he appealed contending that the trial judge erroneously rejected his alibi and relied on evidence of a single identifying witness.

Headnote and Holding: 

The court considered whether the trial court erroneosly rejected the appellant’s alibi. The court held that where the sole defence was an alibi, identification by a single witness had to be conducted with great care and the summing up had to carefully deal with the facts of the identification.
