Search Summary: 

On or about 07 November 2011, the respondents appointed the appellant as a Law Firm to Chair of that Tribunal, serve as Chancellor for the Diocese and render general legal services. It was tacitly understood that the appellant's services would be remunerated. At the conclusion of those proceedings, the appellant presented to the respondents a bill of shs. 35,261,000/= out of which the respondents paid only a sum of shs. 14,000,000/= in instalments over a period of more than two years, leaving an outstanding balance of shs. 21,261,000/= then sought to be recovered by suit.

Headnote and Holding: 

The court in result held that the trial court thus erred in its finding that the amount paid by the respondent was sufficient for the services rendered. That such a determination could only be justified on the basis of a quasi-contractual relationship.
