Search Summary: 

The 2 nd appellant declared the 1 st appellant winner of the
Parliamentary election. Dissatisfied with the results, the respondent
petitioned the High Court challenging the results. He joined the 2 nd
appellant alleging it had failed to conduct the elections in the
Constituency in accordance with the law. The High Court dismissed
the petition. The appellants appealed to the Court of Appeal which
dismissed the appeal. Hence, this appeal.
Court considered whether or not the appellant committed the
electoral offence of bribery.

Headnote and Holding: 

The Supreme Court dismissed the appeal holding that the Court of

Appeal exhaustively reevaluated the evidence and after citing the
relevant law on bribery and electoral malpractice held that the gift
of the cow was clearly intended to influence the voters to vote for
the 1 st appellant.
