This appeal arises from the decision of the trial
court in which the respondent claimed
successfully against the appellant for
negligence in the handling of the cargo by the
appellant leading to losses. The grounds of the
appeal are that there was improper evaluation
of the evidence; there was no negligence on the
part of the appellant and an issue with the grant
of the interest rate.

Headnote and Holding: 

The court held that indeed the appellant owed
the respondent a duty of care but it discharged
it since only a few kilograms of fish were

rejected. That in reaching the amount in the
award of the damages, the price of fish was not
proved and hence an improper evaluation of
the evidence.
