Besigensi Edison v Uganda ((Criminal Appeal No.9 of 2004)) [2005] UGSC 26 (21 December 2005);

The appellant, was indicted, tried and
convicted in the High Court for aggravated
robbery. He was sentenced to death. His appeal
to the Court of Appeal was unsuccessful.
Hence this appeal. The ground of appeal is that
the appellate court didn’t properly evaluate the
evidence on record and wrongly upheld the
finding of the trial judge that the prosecution
proved all the ingredients of robbery against
the appellant.

Headnote and Holding: 

The court held that since the appellant couldn’t

explain the visiting of the shop at the time he
did and cutting the victim with a panga and the
circumstantial evidence proved him to be in
dire need for money.
