The applicant was convicted of corruption contrary to sections 11(1) of the Anti Corruption Act, sentenced to one year imprisonment and disqualified from holding any public office for ten years from the date of conviction. Headnote and Holding: 

The court held that proof of exceptional circumstances in an application for bail pending appeal wasn’t only a rule of practice but a requirement of law under section 15(3) of the Trial on Indictments Act. The court was satisfied that the applicant was of advanced age (60 years) and suffered from grave illness. The court accordingly concluded that the applicant had proved exceptional circumstances for grant of bail pending appeal and granted the applicant bail.
