Search Summary: 

The appellant was required a decretal sum for satisfaction of a judgment
decree which he had guaranteed, the appellant deposited the sum of
money with the court registrar which was collected by the respondent at
the end of the case. The respondent claimed interest on money deposited
in court and the appellant successfully brought a suit challenging the
interest payable and the respondent appealed to the Court of appeal
which allowed the appeal hence this second appeal.

Headnote and Holding: 

The court observed that the learned judge had ordered the deposit of
money until payment was made in full and as such the money accrued
interest until it was fully paid. The court further observed that the
respondent had not waived his right s to enjoy the fruits of litigation by
allowing grant of execution as it’s the appellant who had made the
application for stay of execution.
The appeal was thereby dismissed.
