Kagumya Vs Attorney General (CIVIL APPEAL NO.07 OF 2017) [2018] UGSC 51 (21 December 2018);

Flynote:

Search Summary:

The appeal concerns the retrenchment of a judicial
officer that allegedly was done erroneously. The
background is that the appellant had been
dismissed for bad conduct and reinstated in
allegedly a fraudulent manner that was rescinded.
The applicant sought to be re-instated and the
respondent raised a preliminary objection that the
matter was time barred.

Headnote and Holding:

The court considered whether the matter was time
barred, and whether the appellant had been

unlawfully retrenched and whether he was entitled
to the relief sought.
The court held that as the retrenchment had taken
long before the application to set it aside, it would
be ingenuous to allow it. That the there was no
distinction from common law contracts and the
employment contract as they were all governed by
the law on limitation.
