Loi Kageni & Anor v Gole Nicholas (CIVIL APPLICATION NO. 15 OF 2007) [2007] UGSC 1 (17 October 2007);

Flynote:

Search Summary:

This was an application to strike out a notice of
appeal and the appeal on the ground that it was
fled out of time.

Headnote and Holding:

The court held that the Parliamentary Elections
( Election Petition ) rules are the rules
applicable to the election petition appeals since
they were put in place to expedite the appeal
process and hence the filing was out of time.
That though they were filed out of time, the

interest of justice called for admission of the
respondent to be given more time to file
appropriately.
