The appellant brought a suit against the respondent for recovery of money,
damages, interest and costs of the suit. The respondent raised a preliminary
objection that the plaint did not disclose a cause of action against the
respondent. The suit was dismissed by the trial judge and the appeal to the
Court of Appeal was dismissed too hence this appeal.

Headnote and Holding: 

The observed that the company to which the appellant had supplied items
was a corporate body with capacity to sue in its own name and not the
government as a shareholder in the company.
The appeal was thereby dismissed.
