Search Summary: 

The applicant was charged with offences of illicit enrichment and causing
financial loss against which he challenged the legality of the law under which
he was charged in the constitutional court which dismissed his petition and
returned orders to the trial magistrate to continue with proceedings. The
applicant brought an appeal to the supreme court and the applications for
stay of proceedings by the trial magistrate.

Headnote and Holding: 

The court observed that the applicant had not demonstrated a prima facie
case and that the applicant would not suffer irreparable injury if the
application was not granted nor would the appeal be rendered nugatory and
the balance of convenience was tilted in favor of having the trial expedited so
that the charges against the applicant would be determined.
The application was dismissed
