Lalango Lutara Vs Attorney General (CIVIL APPEAL NO.26 OF 2011) [2019] UGCA 138 (26 April 2019);

Flynote:

Search Summary:

The appellant’s action against the government for forcefully taking over suit land without compensation in 1977 was dismissed on ground that it was time barred. She appealed against the judgment contending that the trial court erred to find that the suit was time barred yet the respondent had acknowledged the debt.

Headnote and Holding:

The court considered whether the appellant’s action was time bared. The court held that where there had been an acknowledgement of a claim the limitation period was deemed to have started running from the date of such acknowledgement. The court was not satisfied that the government had acknowledged liability for the appellant’s claim as there was no evidence to that effect. The court accordingly concluded that the suit was time barred and upheld the trial court’s judgment.
