In Re Anna Namaleme Joloba (an infant) (FAMILY CAUSE N0.51 of 2013) [2015] UGHCFD 16 (12 March 2015);

Flynote:

Search Summary:

This was an application for legal guardian for
purposes of managing a minor’s estate.

Court considered whether the application was
benefitual to the minor in any way.

Court ruled that the paramount consideration

is the interest and welfare of the infants. The
court has to look at the particulars of each
case and decide whether the infant stands to
benefit from the guardianship.

Headnote and Holding:

Court held that the parents of the minor in
this case sought to sell part of the estate in
which the minor has interest in order to
undertake a commercial activity to diversify
their income.
The minor herself is aware of the
undertaking. Court found the activity was
embarked on in the best interest of the child
and that the parents mean well for their only
daughter, no doubt.

Court accordingly granted the application.
