Search Summary: 

The applicant in this petition sought to
challenge the constitutionality of the
amendment which was consolidated with
similar petitions by the other petitioners. At the

commencement of the application, the
petitioner sought to summon the speaker to
give the accountability to the people as the
holder of a public office. The application was
declined on the grounds that the speaker was
immune from proceedings hence the appeal.
The applicant sought to orally examine the
speaker and that the speaker should be
summoned to appear in court.

Headnote and Holding: 

An objection on the contents of the affidavit
was raised and the court considered whether
the affidavit was fatally defective. The court
held that though the affidavit was defective, it
was curable. That an argumentative affidavit
offended the rules and would be struck out.
And since the supporting affidavit had been
struck out, the application would be dismissed.
