Re Moses Mukisa (an infant) (FAMILY CAUSE NO. 0003/2012) [2012] UGHC 88 (3 May 2012);

Flynote:

Search Summary:

In this case the applicants sought court for orders of guardianship of the infant and
later on adopt the child in their home country, America. In support were the affidavits
from the district probation officer and the grandmother of the infant.

Headnote and Holding:

Court considered whether the applicants were suitable for the role of guardianship of
the minor and if it was in the best interest of the child. The court held that the
applicants were suitable and it was in the minor’s best interest. Court was satisfied that
the applicants had been able to show that they could take care of the minor which
would be in his best interest given his medical condition at that material time.
Furthermore court found it necessary to allow the applicants travel with the infant to
their home country where they could finally complete the adoption process of the
infant.
Accordingly court granted the order of legal guardianship to the applicants for the

infant.
