2006 No. 16. The Advocates (Use of Generic Names by Law Firms) Regulations, 2006.

(Made under section 77(1)(a) of the Advocates Act).

In exercise of the powers conferred upon the Law Council by section 77(1)(a) of the Advocates Act, these Regulations are made this 17th day of March, 2006.

  1. Title

These Regulations may be cited as the Advocates (Use of Generic Names by Law Firms) Regulations, 2006.

  1. Interpretation

In these Regulations ‘‘generic name” means a name other than the name of a partner of a law firm.

  1. Format for generic names.
  1. A generic name shall i nclude the word ‘ ‘advocates” at the end of the name of a law firm.
  2. A law firm that uses a generic name shall h ave the partner’s names and qualifications appearing on the letterhead of the law firm.
  3. A law firm that uses a generic name shall have a list of names of all the partners conspicuously stated side by side with the name-plate of the partnership.
  4. Where the name and qualifications of the partner do not fit on the letterhead of the law firm, a reference to the information and where it is to be found shall be included in the letterhead.
  5. A generic name shall not make any reference, actual or derived, to any symbolic, cultic, political, religious, sectarian, discriminatory or specialty classification.
  6. A generic name shall not be—
  1. offensive;
  2. directly or indirectly associated with or suggest any connection with any

government, parastatal or a non-government organisation;

  1. misleading.

  1. Change to generic name

Where a law firm changes its name from the name of a partner to a generic name, its former name shall be included on the letterhead and the name-plate for at least three years.

  1. Registration of generic names

(1) A generic name shall not be used or registered with the Registrar General, or any other authority, until clearance is obtained from the Law Council.

  1. Notwithstanding sub-regulation (1), the Law Council may reject an application to use a generic name, for sufficient cause.
